HIPAA & Texas HB 300 Notice of Privacy Practices (NPP)

Our Legal Duty

At Revitalize Chiropractic, we are required by applicable federal law (HIPAA) and Texas state law (Texas Medical Records Privacy Act / HB 300) to maintain the privacy of your Protected Health Information (PHI). We are also required to give you this Notice about our privacy practices, our legal duties, and your rights concerning your PHI.

Uses and Disclosures of Health Information

We may use and disclose your health information for the following purposes:

  • Treatment: We may use or disclose your PHI to a physician, another chiropractor, or other healthcare provider providing treatment to you (e.g., sending x-rays to a radiologist or referring you to a specialist).

  • Payment: We may use and disclose your PHI to obtain payment for services we provide to you (e.g., billing your health insurance or processing credit card payments).

  • Healthcare Operations: We may use and disclose your PHI in connection with our healthcare operations, which include quality assessment and improvement activities, reviewing the competence or qualifications of healthcare professionals, and practitioner training.

  • Required by Law: We may use or disclose your PHI when we are required to do so by federal, state, or local law.

  • Appointment Reminders: We may use and disclose your PHI to contact you as a reminder that you have an appointment for chiropractic care (via text, email, or phone).

Texas-Specific Privacy Protections (HB 300)

Texas law provides protections that are stricter than federal HIPAA rules. We comply fully with the Texas Medical Records Privacy Act:

  • Prohibition on Sale of PHI: We will not sell your PHI. Texas law strictly prohibits the sale of PHI without your express written authorization.

  • Electronic Health Records Access: If we maintain your health records electronically, Texas law requires us to provide you with those electronic records within 15 business days of receiving your written request (compared to the 30 days allowed under federal law).

  • Breach Notification: In the event of an unauthorized acquisition, access, use, or disclosure of your PHI, we will notify you in accordance with Texas and Federal breach notification laws.

Your Patient Rights

  • Access to Records: You have the right to look at or get copies of your health records. Under Texas law, we must fulfill this within 15 business days of a written request. We may charge a reasonable, cost-based fee for copies.

  • Restriction Requests: You have the right to request that we place additional restrictions on our use or disclosure of your PHI. We are not required to agree to these additional restrictions, except if you pay for a service entirely out-of-pocket and request that we not disclose this information to your health plan.

  • Alternative Communication: You have the right to request that we communicate with you about your PHI by alternative means or to alternative locations.

  • Amendment: You have the right to request that we amend your health information. Your request must be in writing, and it must explain why the information should be amended. We may deny your request under certain circumstances.

If you believe your privacy rights have been violated, you may file a complaint with our office or with the Texas Board of Chiropractic Examiners or the U.S. Department of Health and Human Services. We support your right to the privacy of your health information and will not retaliate against you for filing a complaint.
